Terms & Conditions — Aquaspace Bonaire

1. Definitions
Aquaspace Bonaire: The provider of boat tours on and around Bonaire, including trips to Klein Bonaire.
The Customer: Any person or entity who makes a booking with Aquaspace Bonaire.
2. Applicability
These terms and conditions apply to all services offered by Aquaspace Bonaire, whether booked directly or through third-party platforms (such as Viator).
3. Booking and Payment
Bookings can be made online, by phone, or through an authorized booking platform.
Customers are responsible for providing accurate contact details (such as email address and phone number).
Changes to bookings are subject to availability and may incur additional charges.
Special requests (e.g., dietary requirements) must be communicated at the time of booking. We will do our best to accommodate them.
For private charters:
- Minor changes (such as number of guests or departure time) must be communicated at least 48 hours before departure.
- Changes within 24 hours cannot be guaranteed.
4. Cancellation and Refund Policy
Shared Catamaran Tours:
- Cancel up to 5 days before departure: 100% refund
- Cancel between 2 and 4 days before departure: 25% cancellation fee
- Cancel between 24 and 48 hours before departure: 50% cancellation fee
- Cancel within 24 hours or no-show: no refund
Private Catamaran Charters:
- Cancel between 1 and 14 days before departure: no refund
- Cancel between 15 and 29 days before departure: 50% refund
- Cancel 30 days or more before departure: 100% refund
- No-show: no refund
Cruise Ship Schedule Changes:
- If your cruise ship changes schedule and you are unable to participate in the tour, you will receive a full refund (proof of schedule change required).
- If your ship arrives on a different day, your tour will be automatically rescheduled (subject to availability).
- If rescheduling is not possible, you will receive a full refund.
Cancellations by Aquaspace Bonaire (e.g., weather conditions):
- The captain reserves the right to alter or cancel a tour due to safety concerns.
- In such cases, we offer:
- a full refund, or
- rescheduling to an alternative available date.
Bookings via third parties (e.g., Viator):
- Cancellation terms may vary for third-party bookings. In such cases, the policies of the relevant platform apply.
- Refunds will be processed through the platform used for the booking.

5. Safety and Conduct Onboard
Customers must follow all instructions given by the crew.
Children must be supervised by an adult at all times.
Guests must be physically capable of participating in basic onboard activities. Any medical conditions or allergies must be communicated in advance.
Respectful behavior is expected at all times; excessive alcohol consumption or disruptive conduct may result in removal from the tour without a refund.
Aquaspace Bonaire is not responsible for loss, damage, or theft of personal belongings.
Lost items can be retrieved at our office the following day.
6. Force Majeure
In cases of force majeure (such as severe weather or government measures), Aquaspace Bonaire reserves the right to alter or cancel tours.
In such cases, we will offer an alternative date or a full refund if rescheduling is not possible.
7. Complaints
Complaints must be submitted in writing within 2 days after the tour to info@aquaspacebonaire.nl.
8. Privacy Policy
Your personal data will be handled confidentially and used solely for communication regarding your booking.
We do not share data with third parties unless legally required. See our full privacy policy at www.aquaspacebonaire.nl.
9. Changes to Terms
Aquaspace Bonaire reserves the right to amend these terms and conditions at any time.
The most recent version will always be available on our website.
10. Governing Law
These terms and conditions are governed by the laws of Bonaire. Any disputes will be submitted to the competent court on Bonaire.
